1. General Information
This document governs the terms and conditions of use for the services offered through MitikBoost (SMM panel) and MitikFans (creator directory), both accessible at mitiklive.com/boost and associated subdomains.
The platform is owned and operated by MitikLive, based in Spain. By registering for or using any of the services, the user fully accepts these terms and conditions.
2. Definitions
- MitikBoost: A Social Media Marketing (SMM) panel that enables the purchase of social media growth services (followers, likes, views, comments, etc.).
- MitikFans: A content creator directory and community featuring profile pages, messaging, galleries, private zones, donations, and video calls.
- User: Any person who accesses, registers on, or uses the platform's services.
- Creator: A user who publishes a public profile on the MitikFans directory with content, photos, videos, and/or paid services.
- Balance: Prepaid credit deposited by the user through the accepted payment methods.
3. Age Requirements
Access to and use of the platform is restricted to individuals aged 18 or older. By registering, the user confirms that they are of legal age. MitikFans may contain adult content published by creators; access to such content is the sole responsibility of the user.
4. Registration and Account
In order to use the services, users must create an account by providing a valid email address and a password. The user is responsible for maintaining the confidentiality of their login credentials.
Each individual may create only one account. The platform reserves the right to suspend or terminate accounts that breach these terms, without refund of remaining balance in cases of serious violation.
5. SMM Services (MitikBoost)
5.1. Nature of the Service
MitikBoost acts as a technological intermediary connecting users with third-party SMM service providers. Services include, but are not limited to: followers, likes, views, comments, plays, subscribers, and reactions across more than 20 social media platforms.
5.2. No Permanence Guarantees
SMM services depend on third-party providers and the policies of each social network. No guarantee is made regarding the indefinite permanence of followers, likes, or other metrics. Social networks may remove accounts or interactions without prior notice.
5.3. Delivery Times
Delivery times are estimates only. External factors (provider congestion, social network maintenance, verification processes) may affect timeframes.
5.4. Refill
Some services include an automatic refill guarantee for a limited period. The availability and duration of the guarantee is indicated on each service listing.
6. Creator Directory (MitikFans)
6.1. Public Profile
Creators may publish a public profile containing personal information (name, biography, country, category), photos, and videos. All published content is the sole responsibility of the creator.
6.2. Adult Content
MitikFans permits the publication of adult content (18+). Such content:
- Is moderated automatically using artificial intelligence (NudeNet) and manual review by the administration team.
- Must comply with applicable law: any content involving minors, violence, coercion, or illegal material is strictly prohibited.
- Is published under the sole responsibility of the creator, who warrants that they hold all necessary rights to the material.
6.3. Private Zone
Creators may set up a private zone with paid content. The access price is set by the creator (between 2 and 100 EUR). Payment unlocks all private content on the creator's profile permanently.
6.4. Messaging
The platform provides a direct messaging system between users. Messages may be subject to a fee set by the creator. The use of messaging for spam, harassment, threats, or any unlawful activity is prohibited.
6.5. Paid Video Calls
Creators may offer paid video calls. Charges are billed per minute, with an upfront deposit covering 5 minutes. Any unused balance is refunded upon call completion. Video calls are conducted via WebRTC technology (LiveKit) and are not recorded by the platform.
7. Payments and Balance
7.1. Deposits
Users may add funds to their account using the following payment methods:
- PayPal
- Credit/debit card (via Stripe)
The minimum deposit is 10 EUR. Deposits are credited upon confirmation from the payment provider.
7.2. Use of Balance
Balance may be used to purchase SMM services, unlock private zones, send donations to creators, pay for messages, and make video calls.
7.3. Refunds
Confirmed deposits are non-refundable except in the following cases:
- SMM orders that remain in "Processing" status for more than 24 hours without delivery.
- Unanswered video calls (the deposit is refunded in full).
- Technical errors verified by the support team.
7.4. Revenue Split (Creators)
Creators receive 50% of revenue generated from donations, private zone unlocks, paid messages, and video calls. The remaining 50% is retained by the platform as a service fee. Accumulated balance is not paid out automatically; creator payouts are processed upon request.
8. Intellectual Property
All platform content (code, design, text, logos) is the property of MitikLive or its respective licensors. Reproduction without authorisation is prohibited.
Creators retain intellectual property rights over their content and grant MitikLive a non-exclusive licence to display it on the platform for the duration of their active profile.
9. Prohibitions
The following activities are expressly prohibited:
- Using the platform for illegal or fraudulent activities.
- Publishing any content involving minors in any form.
- Impersonating another person.
- Reverse engineering, scraping, or automated exploitation of the platform.
- Using the messaging system for spam, harassment, or threats.
- Attempting to manipulate the payment, balance, or referral system.
- Sharing login credentials with third parties.
10. Limitation of Liability
MitikLive acts as a technological intermediary and shall not be held liable for:
- Content published by creators or users.
- Loss of followers, likes, or other metrics resulting from social network actions.
- Service interruptions caused by maintenance, external attacks, or force majeure.
- Interactions between users outside the platform.
MitikLive's maximum liability is limited to the balance available in the user's account at the time the claim is made.
11. Applicable Law and Jurisdiction
These terms and conditions are governed by Spanish law and applicable European Union regulations. For the resolution of any dispute, the parties submit to the courts and tribunals of Spain.
12. Modifications
MitikLive reserves the right to modify these terms and conditions at any time. Changes will be published on this page with the updated date. Continued use of the platform following the publication of changes constitutes acceptance thereof.
